Trial Team Secures Unanimous Defense Verdict in Federal Court

On June 17, 2026, an eight-member jury in the United States District Court for the Northern District of Mississippi, Oxford Division, returned a unanimous verdict in favor of Kroger in a premises liability lawsuit.

The defense team, consisting of attorneys Michael Phillips and Chris Herrin, along with paralegals Kate Jurey and Jessica Shelton, successfully represented Kroger throughout the litigation and at trial.

The plaintiff alleged that Kroger was liable for damages arising from the towing of his commercial vehicle after it was parked in the store’s loading dock area. The evidence presented at trial established that the vehicle was parked in violation of the store’s policy and that the plaintiff was not conducting business with the store at the time of the incident.

Following a three-day trial, the jury determined that the plaintiff was a trespasser under Mississippi law and returned a unanimous verdict in favor of Kroger on all claims.
