HAT Attorney Jacob Malatesta Obtains Favorable Ruling from Mississippi Court of Appeals

On May 10, 2022, Jacob Malatesta obtained a favorable ruling for his client from the Mississippi Court of Appeals, affirming a prior dismissal based on the statute of limitations.

The case involved alleged flooding of a rental property in Rankin County near the Pearl River. The owner alleged that Rankin County and the Pearl River Valley Water Supply District (PRVWSD) were responsible for the flooding. Both defendants denied they were responsible, but both defendants also moved to dismiss based on the statute of limitations. The owner argued that he did not know the actual cause of the flooding until recently; however, letters and other correspondence showed he had known about the flooding and had complained to both Rankin County and PRVWSD. Thus, the Court of Appeals affirmed the dismissal.
